Ohio is a monopolistic WC state
Ohio is one of four monopolistic workers' compensation states (along with North Dakota, Washington, and Wyoming), meaning all WC coverage must be purchased exclusively from the Ohio Bureau of Workers' Compensation (BWC). Private WC insurance carriers are not permitted to write Ohio workers' compensation policies. Every Ohio employer with one or more employees must register with the BWC, obtain coverage, and pay premiums directly to the state fund. The Ohio Industrial Commission (IC) handles disputed claims. Ohio's monopolistic structure creates a unique operating environment — premium savings programs offered by the BWC (group rating, retrospective rating, EM cap programs) are critical cost-management tools unavailable in private-market states.
Ohio BWC rate structure
Ohio BWC sets base rates for each NCCI classification code annually. Base rates are reviewed by the BWC's Actuarial Division, recommended by the Administrator, and approved by the BWC Board of Directors. The rate schedule is codified in the Ohio Administrative Code (OAC) 4123-17-06, Appendix A. Rates are effective July 1 of each year. Ohio ranked 5th lowest in WC premium rates nationwide as of June 2025 (BWC press release). All employers pay the base rate plus a Disabled Workers' Relief Fund (DWRF) assessment, creating a "blended rate" that is higher than the base rate alone.
Class code and rate (Ohio 2025–2026)
- Code 9014 — Janitorial Services by Contractors, No Window Cleaning Above Ground Level & Drivers. Ohio BWC base rate: $1.4396 per $100 payroll (effective July 1, 2025; OAC 4123-17-06 Appendix A, enacted March 27, 2025).
- Code 9015 — Building Operation–N.O.C. (in-house building staff). Base rate: $2.2070/$100 (effective July 1, 2025) — higher than 9014 due to multi-trade exposure.
- Note: Ohio uses NCCI class codes but sets its own base rates independently through the BWC actuarial process. BWC rates are not NCCI advisory loss costs.
- Bid-math note: at $1.44/$100 base rate plus DWRF (~$0.10–$0.15/$100), load total Ohio WC cost at approximately 1.5–1.6% of gross wages in Ohio bids — highly competitive vs. NCCI states at national averages.
Indemnity benefits (Ohio 2025–2026)
- TTD rate: 72% of Full Weekly Wage (FWW) for the first 12 weeks; then 66.67% of Average Weekly Wage (AWW) thereafter (ORC §4123.56(A)).
- Max weekly TTD without Social Security retirement (SSR): $1,231/week (2025 policy year); $1,281/week (2026 policy year, injuries after 7/1/2026).
- Max weekly TTD with SSR offset: $820.67/week (2025); $854/week (2026).
- Min weekly TTD: $410.33/week (2025); $427/week (2026); if actual FWW/AWW is less, BWC pays the actual wage.
- Waiting period: 7 calendar days; first 7 days paid retroactively if disability exceeds 14 days (ORC §4123.56(A)).
- PTD: up to $1,231/week (2025), paid for life; subject to SSR offset.
- PPD scheduled benefits: up to 400 weeks per body part schedule (OAC 4123-3-34).
Coverage requirements and exemptions
- Mandatory for all employers with 1 or more employees (ORC §4123.35) — no minimum threshold.
- Sole proprietors and most partners are excluded from mandatory coverage but may elect to include themselves by notifying the BWC.
- Corporate officers who are also the majority stockholder of a corporation with 4 or fewer employees may elect exclusion.
- Independent contractor test: Ohio uses a multi-factor common-law test; BWC will reclassify workers if the economic-reality test shows employment. Janitorial cleaning crews working under a contractor's direction are almost universally employees in Ohio.
Experience rating (Ohio BWC)
Ohio BWC uses its own experience modification system, distinct from the NCCI plan. The BWC calculates an employer's Individual Modified Rate (IMR) based on 4 years of claims history. Employers with small expected losses receive a "manual rate" (no experience modification). Ohio also offers significant premium-savings programs:
- Group Rating: employers join an industry group (administered by third-party group-rating sponsors) that pools experience; groups earn discounts of up to 80% off manual rates. Major program for mid-size janitorial companies.
- Retrospective Rating: premium adjusted at policy end based on actual loss experience; available to accounts with $150,000+ in standard premium.
- EM Cap Program: caps the experience mod increase for employers with one serious injury.
- Safety Intervention Programs (VIPP, SHARP): safety consultation and premium discount programs available through the BWC.
Officer/owner waivers
Sole proprietors file a voluntary election form with the BWC to opt in to coverage. The majority stockholder (over 50%) of a corporation with 4 or fewer employees may file an Officer Exclusion Election with the BWC to remove themselves from coverage. All waivers and elections must be on file with the BWC and are policy-year-specific.
Penalties for non-compliance
- Unpaid premiums: 15% penalty per month on the outstanding balance plus a $30 flat fee per unpaid filing (BWC website; ORC §4123.32).
- BWC may place a lien on employer property and pursue civil collection action.
- BWC may seek criminal charges (fraud or theft) for willful failure to report payroll or pay premiums.
- ORC §4123.99: criminal misdemeanor for first-offense safety order violations.
- Unlike private-market states, Ohio BWC does not issue formal stop-work orders as a primary enforcement tool — it uses premium collection, liens, and civil litigation instead.

- July 1, 2024: Ohio BWC base rates; prior year schedule.
- July 1, 2025: BWC updated base rates per OAC 4123-17-06 Appendix A (enacted March 27, 2025); class 9014 base rate $1.4396/$100. Ohio continues to rank among the lowest 10 states for WC premium rates nationally.
