3. Your responsibility to verify

You are solely responsible for evaluating the suitability of any information in the Content for your situation. Before acting on any information published by Opora, you must:

  1. Read and follow the current manufacturer's label for any chemical or product
  2. Read and follow the current Safety Data Sheet (SDS) issued by the manufacturer, including Section 8 (Exposure Controls / Personal Protection) and Section 10 (Stability and Reactivity)
  3. Verify current federal, state, and local regulatory requirements with the appropriate Authority Having Jurisdiction (AHJ), including but not limited to OSHA, EPA, FDA, the U.S. Department of Transportation, your state environmental and labor agencies, and your local fire marshal and health department
  4. Consult a qualified safety professional, Certified Industrial Hygienist (CIH), Certified Safety Professional (CSP), Professional Engineer (PE), attorney, or other appropriate licensed professional for advice specific to your facility and operations
  5. Provide training to your personnel as required under 29 CFR 1910.1200 (Hazard Communication), 29 CFR 1910.132 (Personal Protective Equipment), and any other applicable standards

4. Regulatory currency and accuracy

Regulations, standards, product registrations, and chemical classifications cited in the Content (including but not limited to OSHA standards, EPA registrations, FIFRA classifications, FDA listings, CARB and state VOC limits, ANSI standards, ISSA guidance, NSF listings, and CFR citations) change frequently and without notice. You may print, share internally within your organization, and use these materials for educational and operational reference. You may not modify them and represent the modified version as Opora content, resell them, or redistribute them commercially without prior written permission.

7. No warranty

THE CONTENT IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. OPORA SUPPLY LLC SPECIFICALLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, CURRENCY, NON-INFRINGEMENT, AND TITLE.

8. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OPORA SUPPLY LLC, ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO PROPERTY DAMAGE, BODILY INJURY, DEATH, LOST PROFITS, LOST DATA, BUSINESS INTERRUPTION, REGULATORY PENALTIES, OR REPUTATIONAL HARM — ARISING OUT OF OR RELATING TO YOUR ACCESS TO, USE OF, OR INABILITY TO USE THE CONTENT, EVEN IF OPORA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In any jurisdiction that does not allow the exclusion of certain warranties or the limitation of certain damages, Opora's liability shall be limited to the maximum extent permitted by law, and in no event shall Opora's aggregate liability to you for any claim arising from the Content exceed one hundred U.S. dollars ($100.00) or the amount you paid Opora in the twelve (12) months preceding the claim, whichever is greater.

The Content may link to or cite third-party websites, publications, standards bodies, regulatory agencies, or other resources. Opora does not control these third parties, does not endorse them, and is not responsible for the content, accuracy, currency, or availability of any third-party material. Your use of any third-party resource is at your own risk and subject to that party's terms.

11. Updates and changes

Opora Supply may update, correct, supplement, or remove any portion of the Content at any time without notice. The "Last reviewed" date on each piece of Content indicates when that piece was last evaluated by Opora, not whether the cited regulations or standards remain current. 14. Governing law and dispute resolution

Any action, suit, or proceeding arising out of or relating to this Disclaimer or the Content shall be brought exclusively in the state or federal courts located in the State of Georgia, and you consent to the personal jurisdiction and venue of those courts.

You and Opora each agree that any dispute shall be resolved on an individual basis. Class actions, class arbitrations, and representative actions are not permitted.

15. Severability and entire agreement

If any provision of this Disclaimer is found unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect. This Disclaimer, together with Opora's Terms of Service and Privacy Policy, constitutes the entire agreement between you and Opora regarding the Content.
