Coverage requirement for PA janitorial employers
Pennsylvania's Workers' Compensation Act (Act 338 of 1915, codified at 77 P.S. §§ 1–1041.4) requires every employer with one or more employees to maintain continuous workers' comp coverage from the first day of employment (77 P.S. § 305(a)(1)). This applies to commercial janitorial contractors (NAICS 561720) across all full-time, part-time, and seasonal staff. Sole proprietors are not legally required to carry coverage. Executive officers of for-profit C corporations may elect out only if they hold at least 5% ownership; S-corp officers may elect out with any ownership interest (77 P.S. § 104). The Act is administered by the PA Bureau of Workers' Compensation under the PA Department of Labor & Industry.
Three coverage channels
- Private insurers — any insurance carrier licensed in the Commonwealth.
- State Workers' Insurance Fund (SWIF) — PA's statutory insurer of last resort, headquartered at 100 Lackawanna Avenue, Scranton. SWIF accepts any employer required by law to carry workers' comp, making it a critical option for janitorial contractors refused by private carriers due to high turnover or limited operating history. Apply directly via pa.gov.
- Self-insurance — requires PA BWC approval, a $500 application fee, and proof of financial ability to pay all claims; renewable annually at $100 (77 P.S. § 305(a)(1)–(3)). Group self-insurance pooling is also available under Article VIII.
PCRB classification and 2026 rates
Pennsylvania does not use NCCI directly — the Pennsylvania Compensation Rating Bureau (PCRB) is the licensed rating organization for the Commonwealth. Commercial janitorial (NAICS 561720) is classified under Code 9014 — Janitorial Services by Contractors in PCRB's manual, with residential interior cleaning split to Code 9017 as of 2023. PCRB rating values effective April 1, 2026 reflect an overall 1.22% decrease approved by the PA Insurance Department. Approximate loss cost for Code 9014: $2.40–$2.60 per $100 of payroll. Actual premium depends on carrier markup and employer experience modifier.
2026 maximum weekly compensation rate
The PA Statewide Average Weekly Wage (SAWW) for 2026 sets the maximum weekly benefit at $1,394.00 for injuries on or after January 1, 2026 — a 3.5% increase over the 2025 cap of $1,347.00. Benefit calculation: 66⅔% of the injured worker's average weekly wage, capped at $1,394.00; or a flat $697.00 for AWW between $774.44 and $1,045.50; or 90% of AWW if AWW is at or below $774.43.
Penalties for noncompliance (77 P.S. § 305(b))
- Misdemeanor of the third degree: up to $2,500 fine and/or one year imprisonment per day of noncompliance. Every day without coverage is a separate offense.
- Felony of the third degree if the court finds the failure intentional: up to $15,000 fine and seven years imprisonment per day.
- Direct civil liability for all comp benefits, plus reimbursement to the Uninsured Employers Guaranty Fund with interest, penalties, and fees.
- $200/day (up to 30 days) for failure to respond to a BWC information request.
Subcontractor certificate of insurance requirement
Prime janitorial contractors must obtain proof of insurance from every subcontractor before subcontracting any portion of a contract (77 P.S. § 302(d)). "Proof of insurance" means a current certificate of insurance or self-insurance (77 P.S. § 302(i)). Failure exposes the prime to derivative liability for the subcontractor's uninsured employees — including direct payment of benefits and statutory penalties.
Practical first steps for PA janitorial operators
- Verify your PCRB classification — Code 9014 vs. 9017 vs. 0971 (Buildings — Commercial) can swing your loss cost meaningfully. Misclassification is one of the most common sources of premium audit disputes.
- Get a SWIF quote alongside private market quotes, especially for new operators, contractors with prior claims, or those with experience modifiers above 1.10.
- Track certificates of insurance for every subcontractor, with expiration dates and automatic renewal alerts. Derivative liability under § 302(d) is enforced on audit.
- Post the PA Notice of Compensation at every job site (required under 77 P.S. § 632). The BWC supplies free posters.
