How workers' comp works for janitorial in Illinois
Illinois workers' compensation is governed by the Workers' Compensation Act (820 ILCS 305/) and administered by the Illinois Workers' Compensation Commission (IWCC). Officer/owner waivers
Under 820 ILCS 305/§3.20, a sole proprietor or partner may opt out of coverage by filing written notice with the IWCC. Corporate officers cannot exclude themselves from coverage unless they are also sole proprietors. For LLC members, the member is considered an employee if working in the business. Illinois does not have an officer exclusion form equivalent to many other states — coverage is mandatory for any officer receiving wages.
Penalties for non-compliance
- Under 820 ILCS 305/§4(d), an uninsured employer is liable for twice the compensation that would otherwise have been owed to any injured worker.
